Terms and conditions for guided city tours by bike
- 1 Services
Our contractual services are based on confirmed booking, confirmation of the order and include the services announced on our Internet website and/or flyers. Further agreements which might alter the extent of the contractual services need to be confirmed in written by frankfurtbiketour.com.
- 2 Guided city tours
Guided city tours by bike might be subject to variations of the originally planned route. Frankfurtbiketour.com reserves the right to modify both the itinerary and the programme in case of building sites, closures and similar unforeseen events of force majeure. Our clients will be immediately informed by frankfurtbiketour.com, should this be the case. Our guides however may arrange alternative itineraries on the spot, should the service need to be adapted to local facts and circumstances. Tours take place regardless of weather conditions as long as the safety of the clients is guaranteed. Bike tours could be replaced by walking tours in case of very bad weather.
- 3 Cancellations, changes of booking and withdrawals
The client is entitled to withdraw contractually from extra tours before the tour. Until the 28th day before the service cancellations and changes of booking are free of charge.
After that, the following costs will be charged:
From the 27th to the 15th day prior to the service: 25%
From the 14th to the 4th day prior to the service: 50%
From the 3rd day prior to the service: 90%
Under peculiar circumstances such as very bad weather frankfurtbiketour.com can offer the client a free changement of booking or free recission.
If single participants (max. 10% oft the whole group) have to be cancelled due to illness, no cancellation fee is charged as long as we are informed via mail about the new number of participants up to 24 hours before the tour.
Special regulations for bad weather conditions:
In the event of incessant and heavy rainfall we either offer a walking tour instead of the bike tour or we agree upon a new tour at the earliest possible date.
- 4 Safety
Participation is at one‘s own risk. During a guided bike tour the participating client must obey the valid traffic laws and regulations. Frankfurtbiketour.com is not liable for damages due to gross negligence or wrongful intention. Prior to the tour the participating client must evaluate him/herself whether or not his/her participation is in line with his/her physical conditions.
- 5 Limitation of liability/waiver
Frankfurtbiketour.com is not liable for damages caused by hidden defects or faulty material of the hired bikes. The participating client is requested to check and test the reliability of the rented bike prior to the tour.
- 6 Notice of defects
In case of unsatisfactory performance or service the client is entitled to remedial action. The participating client is obliged to notify occurring defects or flaws immediately either to the guide or calling the below mentioned number. Frankfurtbiketour.com can refuse remedial action if this should require excessive expenditure. If any defect or fault is not reported deliberately, claims on behalf of the client can be rejected partially or entirely.
- 7 Data protection regulation
Personal data provided by the participating client are processed and used to comply with the contractual service and customer care. Frankfurtbiketour.com commits oneself to respecting the federal data protection regulations while asking for, processing and using personal data.
Terms and conditions for bike rental
- 8 Transaction of hired objects
The lessor commits himself to handing over objects for hire in perfect technical conditions. The hirer confirms with his/her signature the transacted objects for hire to be in perfect technical conditions. The hirer must prove his/her identity with a valid identity card. He/she agrees upon the collection of necessary personal data.
- 9 Terms of payment
The hire charge – according to our current price list – has to be paid on signing the hire contract.
- 10 Booking and prolongation of bike hire
Booking can be cancelled free of charge up to 24 h prior to the booked date. The lessor must be informed of any prolongation before the agreed hire time has expired.
- 11 Use of hired objects
The hirer acknowledges with his/her signature that he/she is able to control and ride a bike, that he/she knows the traffic laws and regulations and their implicit obligations . He/She is not allowed to ride off cycling tracks and roads, take part in sports competitions or let hired objects without a written permission from frankfurtbiketour.com. The hirer commits to not leaving hired objects unattended as to be stolen. When not in use the hired object has to be locked to fixed objects such as posts. The lock is provided by frankfurtbiketour.com. For any loss the client will be charged for the amount of the objects to be procured. Theft has to be reported to the police.
- 12 Waiver
The lessor is liable up to a limited amount for damages regarding persons and objects, if the damage was clearly caused by his wrongful and negligent conduct. Claims must be forwarded immediately or on returning the objects (bikes) at the latest. Any liability is excluded in case of hidden defects or flawed material. The lessor is not liable for any damage of the hired object.
- 13 Client liability in case of damage
The hirer commits to returning the bike in perfect conditions. Damages at the bike or the bicycle lock will have to be indemnified to the extent of the costs of repair. Claims have to be made by the lessor immediately after the bike has been returned. Only franfurtbiketour.com can repair hired objects. The hirer is not allowed to undertake any repair or have any repair done without prior permission from frankfurtbike.com.
- 14 Accidents
In case of an accident the hirer must call the police and get the number/code of the accident report, which must be communicated to the lessor along with further information and details regarding the accident.
- 15 Further regulations
The relationship between the client and frankfurtbiketour.com is regulated exclusively by the law of the Federal Republic of Germany. Jurisdiction and the place of performance are in Frankfurt upon Main. The legal invalidity of single parts of our general terms and conditions does not invalidate the remaining regulations.
